(a)        ABRA RUGS Kereskedelmi Kft. (ABRA) operates the commercial page (Webshop) available at a www.abrarugs.com (Website), where, within the framework of electronic commerce services, mainly hand-knotted, individual carpets and related additional products are offered for sale. Services related to the legal transactions between ABRA, and users entered into through the Webshop as well as the rights and obligations of the parties are defined in these general terms and conditions (GTC), which are continuously available on the Website.

(c)        The GTC is effective from 15 October 2024 and is applicable until revoked. ABRA may unilaterally amend the GTC. The changes will be published on the website of the Webshop 15 days before they take effect. In matters not regulated in the GTC, as well as regarding the interpretation of the GTC, Hungarian law shall govern.

Scope of products and related services

(a)        The Webshop may be used to purchase the products listed there. No registration is required to purchase the products.

(b)        The products displayed in the Webshop are divided into categories. You can use filters to find the product you are looking for. The products are unique in each case, no two of them are alike.

(c)        The Webshop contains in detail the names, sizes, descriptions, main features of the products and displays a photo of each product. The images displayed on the product data sheet may differ from the actual ones and are used only as illustrations.

(d)        The prices shown for the products are in Euro, and include VAT. The prices shown for the products include the cost of home delivery within the European Union and the cost of packaging. We are able to deliver outside the European Union on the basis of an individual delivery offer, in which case the delivery fee will be invoiced separately to the Customer.

How to buy

(a)        You can place your order in the Webshop without registration by filling in the data on the CART page and clicking on the SUBMIT ORDER button.

(b)        By submitting the order, you declare that you have read and accept the terms and conditions of the GTC and the Data Management and Privacy Policy.

(c)        Order process:

i.            Selecting the product(s): You can use the product categories in the menu to select the product(s) you want to order. Click on the small image of the product to see more details and a larger photo of that product. On this page, you can add it to your shopping cart by clicking the ADD TO CART button.

ii.           Order: After selecting the product(s) you want to buy, the order can be finalized by clicking on the CART link in the upper right corner, then after placing the delivery, determining billing and personal data, as well as the purchase payment method, you can place an order by clicking the SEND ORDER button. You can only place your order if you have provided all the information required.

(d)        We can only check the availability of the products when processing the order.

(e)        We will confirm the receipt of your submitted offer (order) by e-mail within 4 hours at the latest, which confirmation e-mail contains the data provided during the purchase (e.g. billing and delivery information), the order ID, the order date, the ordered the list of items, the quantity, the price of the product and the final amount to be paid. The confirmation e-mail is considered an acceptance of your offer, with which a valid contract is concluded between ABRA and you as a customer. The order is considered to be an electronically concluded contract.

(f)         If you placed your order accidentally or incorrectly, you may cancel it without any consequences before dispatching the product via email to the e-mail address hello@abrarugs.com or to one of the contact details provided on the site.

Payment Options

You can pay for the products purchased in the Webshop by online credit card payment. In case of payment by credit card:
i.    The card payment service of the Webshop is served by Stripe’s online payment solution.
ii.    Internet payment is free for cardholders.
iii.    Attention! For Maestro and Visa Electron cards, the card's use of the card is determined by the issuing bank. If authorized by the issuing bank, then our system can accept it.
iv.    Cardholders are identified by a 3-digit verification code in the card's signature panel - also known as CVC2 or CVV2. Handle this code with the same care as the PIN code!
v.    We do not store your credit card details on any server, and we do not have access to your card details, we cannot initiate further transactions with your card details, so you must do this in all cases if you buy from us again.
vi.    At the same time, we have access to a list of transactions for that day, where we can verify that the payment was successful. On this interface we see the first 6 and the last 4 characters of your card, respectively the expiration date of the card. We can't access the security code, full card number, and your name, so we can't misuse your information.

Fulfillment of orders

(a)    Orders will be fulfilled by personal handover or home delivery by courier service. The prices displayed in the Webshop for the products include the home delivery fee within the European Union and the packaging cost. We are able to deliver outside the European Union on the basis of an individual delivery offer, in which case the delivery fee will be invoiced separately.
(b)    Based on your choice, the ordered products can be picked up at a pre-agreed time (but not earlier than within 1 working day after the order) at our registered office: 1126 Budapest, Ugocsa utca 2. 3.em. 3.a. or at our showroom: 1075 Budapest, Nagy Diófa utca 30-32.
(c)    Based on your choice, the ordered products will be delivered to your home free of charge in Hungary or in the European Union via the GLS courier service. Delivery time is usually 2-6 working days from the order. We will send you information by e-mail about the date of delivery. 
(d)    Incoming orders will be automatically registered and handed over to the courier service after the package has been assembled. Another notice will be sent when the package is compiled and then on the morning of the day of delivery. Delivery will be made by GLS between 8am and 5pm.
(e)    We cannot influence the exact delivery of the packages; the packages will be carried out by GLS couriers according to the most optimal fulfillment of the address list collected on the given day. A change of date can be requested from the GLS customer service telephone number (+36-29-88-66-40). Delivery notices include the package number, which allows you to track the path of the package or request a time change.
(f)    We cannot be held liable for delivery if the delivery delay or other problem or error is due to inaccurate and / or incorrect information provided by you.

Damaged, defective products

(a)    ABRA products are unique handcrafted products that may be characterized by a degree of imperfection. Such imperfections are due to the nature of the products and do not constitute damage or defect within reason.
(b)    At ABRA, one of the main aspects is that the quality of the products always meets the expectations. However, if the product is still defective and we did not notice it when packing, then if you return the product to ABRA, we will refund the price to the specified bank account or act to correct the product defect upon your request.
(c)    When assembling each package, we pay special attention to the protection of the products, accordingly we supply our products with damage-proof packaging materials as safely as possible. If, nevertheless, the products arrive damaged to you, please report the problem to us at hello@abrarugs.com. What we need for a quick solution: order number, name and number of damaged products, and photos of damaged products. In the event of damage, keep the package (both in its original condition and in the product) and report such damage immediately. The courier service can investigate the circumstances of the damage, so pictures of the damage and packaging will help with the job, but we may also need a damage inspection for a full investigation. You must notify us within 3 working days of receipt, if no damage report has been made at the time of receipt. All damage complaints will be handled as quickly as possible and the price of the proven damaged product will be refunded to the specified bank account or we will act to correct the product defect upon your request

Withdrawal, replacement 

(a)    On the basis of Gov. Decree No. 45/2014 (II. 26.) on contracts concluded in absentia, the user (buyer) who qualifies as a consumer may withdraw from the purchase without giving reasons within 14 calendar days after receipt of the goods.
(b)    You may exercise your right of withdrawal from the day you receive the goods, as evidenced by the customer copy of the consignment note received on delivery. If you exercise your right of withdrawal, please email us about this and the details of the return. You must return the product in its original, undamaged condition together with the invoice and the return form to the ABRA headquarters or site as previously agreed. We can only refund the full purchase price if the product is returned in new condition (undamaged, complete and in original packaging). Exercising the right of withdrawal does not incur any additional costs for you, but you must arrange for the return of the product and bear the cost of it. 
(c)    You are also entitled to exercise your right of withdrawal in the period between the date of concluding the contract (placing an order) and the date of receipt of the product, within 14 days from the date of concluding the contract. 
(d)    If the package returned with the right of withdrawal meets the above conditions, ABRA will return the purchase price to you in full within 10 banking days of receiving the package to the previously provided account number. 
(e)    Due to the unique nature of the products, there is no possibility of exchange. 

Enforcement Options

(a)    Complaint
The user may submit a complaint regarding the activities of ABRA at any of the above contact details of ABRA.
(b)    Oral Complaint
An oral complaint, if we have the opportunity, will be investigated and remedied immediately. If we do not have the opportunity to investigate and remedy the oral complaint immediately, we will take minutes and proceed in accordance with the provisions applicable to the written complaint. A copy of the minutes will be handed over to the user on site. In the case of an oral complaint communicated by telephone or other electronic means of communication, a copy of the minutes shall be sent to the user at the latest at the same time as the substantive reply.
(c)    Written Complaint
Complaints that are not immediately remedied will be uniquely marked to make it easier to identify. The complaint will be investigated immediately, but within a maximum of 15 days. The result of the investigation of the complaint will be communicated to the user in writing within a maximum of 30 days after the complaint has been made. The 30-day time limit shall be deemed to have been observed if the written reply is sent on the 30th day following the lodging of the complaint. If the user's complaint is rejected, we will inform the user of the reason for the rejection.
(d)    Initiation of Legal Proceedings
If a dispute arises in connection with the contract concluded between ABRA and the user and the parties are unable to resolve the dispute amicably within 30 days of its occurrence, the dispute shall be settled in accordance with Act CXXX of 2016 on Civil Procedure by a court with jurisdiction.
(e)    Additional consumer dispute resolution options
i.    Possibility to complain to the consumer protection authority
The user has the right to lodge a complaint with the competent consumer protection authority of his place of residence. Following the assessment of the complaint, the authority shall decide on the conduct of the consumer protection proceedings. The list and contact details of the competent authorities are available at http://jarasinfo.gov.hu. 
ii.    Possibility to turn to a conciliation body
For the purpose of an out-of-court settlement of consumer disputes concerning the quality, safety and application of product liability rules and the conclusion and performance of the contract, the user may initiate proceedings with the conciliation body of his place of residence or domicile of ABRA. For the purposes of the rules applicable to conciliation bodies, a non-governmental organization, church, condominium, housing association, micro, small and medium-sized enterprise according to a separate law, which buys, orders, receives, uses products or is recipient of commercial communication related to products shall also qualify as a customer. Based on the user's place of residence, he / she can turn to the conciliation bodies available at http://www.fogyasztovedelem.kormany.hu/node/8579 in order to settle the consumer dispute. ABRA is obliged to participate in the conciliation board proceedings. For the purposes of this section, sending a reply is considered cooperation.

Miscellaneous provisions

(a)    Purchasing in the Webshop presupposes that users are aware of and accept the possibilities and limitations of the Internet; ABRA assumes that the potential risks related to browsing and shopping are assessed by the users, ensuring the safe use of their computer and the protection of the data stored on it.
(b)    ABRA shall not be liable for damages resulting from the use or malfunction of the Website, changes to the data by anyone, delays in the transmission of information, viruses, software errors, internet network errors, other technical errors, line or system errors.
(c)    ABRA makes every effort to ensure that the information (price, availability, description of products) appearing on the Website is as accurate as possible. The obviously wrong, incorrect price indication due to a system error or typing error (e.g. decimal point difference) does not qualify as an invitation to make an offer; in such case ABRA may refuse the sale or offer the user the option to purchase at the actual price. The pictures next to the products are illustrations, in each case the product description contains the characteristics of the product. ABRA is liable for any errors that may occur in accordance with 45/2014. (II. 26.) and the Civil Code.
(d)    ABRA reserves all rights in the abrarugs.com domain, the Website, any part thereof and the content appearing on it, as well as the distribution of the Website. The Website and its contents are copyrighted. Without the written consent of ABRA, it is prohibited to download (duplicate), re-transmit to the public, otherwise use, electronically store, process or sell the content appearing on the Website or any part thereof. Any material may be taken over from the Website and its database, even with written consent, only with reference to that Website.
(e)    ABRA respects the customers’ fundamental constitutional right to the protection of their personal data. We are committed to paying special attention to the information self-determination right of our customers. In this spirit, we process personal data in compliance with the applicable laws in force at any time. The Data Management and Privacy Policy for each data management activity can be found on the website under the menu item “Data Management and Privacy Policy”.
